1. Introduction
Welcome to Healthy Medicine. These Terms and Conditions ("Terms") govern your use of our website (https://healthymedicine.co.za) and the health and wellness coaching services provided by us globally. By accessing our website or booking a consultation from any country, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
2. Medical Disclaimer
IMPORTANT: PLEASE READ CAREFULLY.
- Educational Purpose Only: The content provided on this website and during consultations is for informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
- No Doctor-Patient Relationship: Use of this website or our services does not establish a doctor-patient relationship.
- Consult Your Physician: Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this website or discussed in a coaching session.
- Not a Medical Service: Healthy Medicine and its practitioners are health coaches, not medical doctors. We do not diagnose, treat, or cure any disease or medical condition.
3. Services and Booking
- Scope: We provide holistic health coaching, nutritional guidance, and lifestyle support.
- Booking: Consultations are booked online via our scheduling platform. You agree to provide accurate and complete information during the booking process.
- Payment: Full payment is required to confirm your booking. All fees are stated clearly on our booking page and are subject to change without notice.
4. Cancellation and Refund Policy
We understand that life happens. However, to respect the time of our practitioners and other clients, the following policy applies:
- Cooling-Off Period: In accordance with the Electronic Communications and Transactions Act (ECTA), you may cancel an advance booking within 7 days of making the transaction, provided the service has not yet begun.
- Cancellations by You:
- More than 24 hours notice: You may reschedule or cancel for a full refund.
- Less than 24 hours notice: Cancellations made less than 24 hours before the scheduled time are non-refundable.
- No-Shows: Failure to attend a scheduled session without prior notice will result in forfeiture of the full session fee.
- Refund Processing:
- Refunds are processed via our payment provider (Yoco) to the original method of payment.
- Transaction Fees: Please note that refunds may be processed less any applicable transaction fees charged by the payment processor, which are non-refundable to us.
- Timeline: Refunds typically take 5-10 business days to reflect in your account, depending on your bank's processing times.
- Cancellations by Us: If we need to cancel your appointment for any reason, we will offer you a full refund or the option to reschedule at your convenience.
5. Client Responsibilities
- Honesty: You agree to provide honest and accurate information about your health history and lifestyle.
- Engagement: You acknowledge that coaching is a collaborative process and your results depend on your own effort and commitment.
- Personal Responsibility: You accept full responsibility for your own health and well-being and for any decisions or actions you take based on our coaching.
6. Limitation of Liability
Why this clause exists: While we strive to limit our liability entirely in Section 2, some jurisdictions (including South Africa under the CPA and other international consumer laws) do not allow for a complete exclusion of liability for certain types of damages (e.g., gross negligence). This clause acts as a "safety net" to ensure that if we are found liable by a court, the financial damages are capped at a reasonable amount (the fees you paid), protecting our business from catastrophic claims.
To the fullest extent permitted by applicable law:
- Healthy Medicine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
- Liability Cap: Our total cumulative liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us in the 3 months preceding the claim.
7. Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of Healthy Medicine and is protected by copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.
8. Governing Law and International Use
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
- International Use: We provide services globally. If you access our services from outside South Africa, you are responsible for compliance with your local laws. You acknowledge that our advice is based on holistic health principles which may differ from medical guidelines in your specific country.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
